Is an Admin Assistant Nonexempt? -

Dear SOS:

Our school attorney recently concluded a wage/hour audit for the school and determined the admin assistant to the head of school is nonexempt and must be paid overtime if she works more than 40 hours in any given work week. She is presently paid a salary with no documentation of her overtime. Her hours change from week to week depending on after-hour meetings or school events. Can we still pay her a salary?
